PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING THE PURESCAN APPLICATION. BY DOWNLOADING, ACCESSING, OR USING PURESCAN ("THE APP"), YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS OF SERVICE ("TERMS"). IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRETY, YOU MUST NOT DOWNLOAD, ACCESS, OR USE THE APP.
PureScan provides an artificial intelligence-assisted informational service that allows users to scan product barcodes, analyze food ingredient content, track self-identified allergens, assess potential compatibility with religious dietary practices (Halal/Kosher), and participate in community-driven feedback and voting features. The App aggregates data from third-party sources, including the OpenFoodFacts database, and applies automated/AI-assisted analysis and OCR technology to present informational outputs to the user.
THIS SECTION CONTAINS CRITICAL LEGAL DISCLAIMERS THAT LIMIT OUR LIABILITY. PLEASE READ IT CAREFULLY.
2.1 No Guarantee of Accuracy. The App's artificial intelligence analyses, Optical Character Recognition (OCR) outputs, ingredient interpretations, allergen flags, religious dietary compatibility assessments (Halal/Kosher), and any community-submitted comments, ratings, or votes (collectively, the "Outputs") are generated through automated processes, third-party data sources, and/or user-generated content. THE OUTPUTS DO NOT, AND CANNOT, CARRY ANY GUARANTEE OF ONE HUNDRED PERCENT (100%) ACCURACY, COMPLETENESS, RELIABILITY, OR CURRENTNESS. Errors may arise from, without limitation: misprinted or mislabeled product packaging, OCR misreading of text, outdated or incorrect third-party database entries (including OpenFoodFacts), manufacturing changes not yet reflected in any database, or inaccuracies in community-submitted content.
2.2 NOT MEDICAL ADVICE. THE OUTPUTS PROVIDED BY THE APP DO NOT CONSTITUTE, AND SHALL NOT BE CONSTRUED AS, MEDICAL ADVICE, MEDICAL DIAGNOSIS, MEDICAL TREATMENT, OR A SUBSTITUTE FOR CONSULTATION WITH A LICENSED PHYSICIAN, ALLERGIST, DIETITIAN, OR OTHER QUALIFIED HEALTHCARE PROFESSIONAL. USERS WITH FOOD ALLERGIES, INTOLERANCES, OR ANY MEDICAL CONDITION MUST INDEPENDENTLY VERIFY ALL PRODUCT INGREDIENTS DIRECTLY FROM THE PHYSICAL PRODUCT PACKAGING AND/OR CONSULT A QUALIFIED MEDICAL PROFESSIONAL BEFORE CONSUMING ANY PRODUCT. Reliance on the App's allergen-tracking feature in place of reading the physical product label is done entirely at the user's own risk.
2.3 NOT A RELIGIOUS RULING (FATWA) OR CERTIFICATION. The App's Halal and Kosher compatibility assessments are informational estimates only, generated by automated analysis of available ingredient data. THESE ASSESSMENTS DO NOT CONSTITUTE, REPLACE, OR CARRY THE AUTHORITY OF AN OFFICIAL RELIGIOUS RULING (FATWA), RABBINICAL RULING, OR FORMAL THIRD-PARTY RELIGIOUS CERTIFICATION issued by a recognized religious authority or accredited certification body. PureScan makes no representation, express or implied, that any product identified as "compatible" has been formally certified by any religious authority. Users who require religious-law certainty must seek confirmation from an official, accredited religious certifying body.
2.4 Ultimate User Responsibility. BY USING THIS APP, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT THE FINAL DECISION TO PURCHASE, PREPARE, OR CONSUME ANY PRODUCT RESTS SOLELY AND ENTIRELY WITH YOU, THE USER. PureScan, its developers, officers, employees, and affiliates shall bear NO RESPONSIBILITY OR LIABILITY WHATSOEVER for any allergic reaction, adverse health event, injury, death, religious non-compliance, dietary violation, financial loss, or any other direct, indirect, incidental, consequential, special, or punitive damages arising from or related to: (a) reliance on any Output generated by the App; (b) inaccuracies in OCR or AI-generated content; (c) inaccuracies in third-party data sources; or (d) reliance on community-submitted content. THIS LIMITATION OF LIABILITY APPLIES TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, regardless of the legal theory asserted (contract, tort, negligence, strict liability, or otherwise), and regardless of whether PureScan has been advised of the possibility of such damages.
2.5 "AS IS" / "AS AVAILABLE" Basis. The App and all Outputs are provided strictly on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
By using the App, you agree that you will NOT, and will not assist or permit any third party to:
Violation of this Section 3 may result in immediate suspension or permanent termination of your account, at PureScan's sole discretion, without prior notice, and may expose you to civil and/or criminal liability.
4.1 Ownership. All right, title, and interest in and to the App — including, without limitation, its name ("PureScan"), logo, trademarks, visual design, user interface, source code, underlying software architecture, database structure, and all related intellectual property — are and shall remain the exclusive property of PureScan Management and its licensors. Nothing in these Terms shall be construed as transferring any ownership rights to the user.
4.2 Limited License. Subject to your compliance with these Terms, PureScan grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App solely for your personal, non-commercial use on a compatible device that you own or control.
4.3 User-Generated Content. By submitting any comment, vote, review, or other content through the community features, you grant PureScan a worldwide, royalty-free, perpetual, irrevocable, sub-licensable license to use, reproduce, display, and distribute such content in connection with the operation and promotion of the App. You represent that you own or have the necessary rights to grant this license for any content you submit.
4.4 Third-Party Data. Product and ingredient data sourced via the OpenFoodFacts API remains subject to the intellectual property terms and open-data licensing of OpenFoodFacts and its respective contributors. PureScan claims no ownership over such third-party-sourced raw data.
PureScan reserves the right to suspend or terminate your access to the App at its sole discretion, with or without notice, for any violation of these Terms. You may terminate your use of the App at any time by deleting your account via the in-app account deletion function described in our Privacy Policy.
These Terms shall be governed by and construed in accordance with the laws of [Insert Governing Jurisdiction], without regard to its conflict-of-law provisions, except where mandatory consumer-protection law of the user's country of residence requires otherwise.
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and PureScan regarding the use of the App.
